General terms and conditions

1. Scope of application

These terms and conditions apply to contracts for the rental of rooms/holiday flats as well as to all other services offered by Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH in this context.

The subletting or reletting of the rooms/holiday flats provided as well as their use for purposes other than those agreed require the prior consent of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH.

The customer’s general terms and conditions of business shall only apply if Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH has expressly acknowledged them in text form (fax, e-mail, letter) prior to the conclusion of the contract.

2. Conclusion of contract, contracting parties, limitation period

The contract shall be concluded by acceptance of the customer’s application by Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH. The customer’s application may be made in text form, by telephone or verbally. Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall be free to confirm the acceptance in text form.

The contracting parties are Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH and the customer. If a third party acts on behalf of the customer, it shall be liable together with the customer to Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH as joint and several debtors, if Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH has received a corresponding declaration from the third party. The same shall apply after permitted subletting/rental.

All claims against Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall in principle become statute-barred one year after commencement of the knowledge-dependent regular limitation period of Section 199 (1) of the German Civil Code (BGB). Irrespective of knowledge, claims for damages shall become statute-barred after five years. The reductions in the statute of limitations shall not apply to claims based on an intentional or grossly negligent breach of duty on the part of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH.

3. Services, payment, set-off

Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH is obliged to keep the rooms/holiday flats booked by the customer ready and to provide the agreed services as well as to accept the agreed price in cash or by EC card. An advance payment in favour of the bank account of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH may also be made by arrangement. Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH is not obliged to accept foreign currencies.

The customer is obliged to pay the agreed price plus applicable taxes and local charges for the provision of the agreed premises at the latest at the time of arrival. This does not include such charges as are owed by the customer himself under local law, such as visitor’s tax. Other agreed services of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH must also be paid for in advance by the customer in the agreed amount.

Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall be entitled to demand a reasonable advance payment or security deposit from the customer or the third party acting on the customer’s behalf upon conclusion of the contract. The amount of the advance payment and the payment dates may be agreed in text form in the contract.

The customer may only set off or reduce a claim or exercise a right of retention against a claim of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH with an undisputed or legally binding claim.

4. Withdrawal of the customer, cancellation and withdrawal conditions

The customer has the right to withdraw from the contract with Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH before the day of arrival. The customer must inform Andresen Zimmer und Wohnungen Verwaltungs GmbH of the withdrawal in text form. The following conditions apply to withdrawal:

– Cancellation up to 30 days before the date of arrival: free of charge
– Cancellation up to 15 days before the date of arrival: 40% of the agreed price.
– Cancellation up to eight days before the date of arrival: 50% of the agreed price.
– Cancellation up to three days before the day of arrival: 70% of the agreed price.
– Cancellation up to 48 hours before the day of arrival: 80% of the agreed price.

If a reduced price is due, the customer is entitled to prove that the aforementioned flat-rate price is unreasonably high, for example because the expenses saved or the income generated from renting the room/holiday flat elsewhere is higher.

If the customer does not withdraw, he shall pay the agreed price even if he does not make use of the contractual service. In this case, Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall offset the income from renting the rooms/holiday flats to other parties and the saved expenses against the agreed price. If the rooms/holiday flats cannot be let to other parties, Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH may demand the agreed price and make a flat-rate deduction for saved expenses. The customer shall then be obliged to pay at least 90% of the agreed price. The customer is at liberty to prove that the aforementioned claim did not arise or did not arise in the amount demanded.

The customer shall not be obliged to pay in the event of a breach of the obligation of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH to show consideration for the rights, legal assets and interests of the customer, if the customer can no longer reasonably be expected to adhere to the contract as a result, or if any other statutory or contractual right of withdrawal exists.

5. Resignation of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH

If the customer does not fulfil his obligation to pay the agreed price on time, Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH may withdraw from the contract. The same shall apply if the customer fails to make the required advance payment/provide security even after the company has granted the customer a reasonable period of grace.

Furthermore, Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall be entitled to withdraw from the contract for factually justified reasons. These include in particular:

– Force majeure or other circumstances for which Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH is not responsible and which make it impossible to fulfil the contract;

– Renting of premises under misleading or false information of essential facts, e.g. the person of the customer or his purpose of stay,

– Andersen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH has reasonable grounds to assume that the use of the rental may jeopardise the smooth running of the business, the security or its reputation in public, without this being attributable to its sphere of control or organisation,

– the customer sublets/renews the premises without permission.

In the event of a justified withdrawal by Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH, the customer shall have no claim for damages.

6. Providing, handing over and returning the room/holiday flat

Booked rooms/holiday flats are available to the customer from 11 a.m. on the day of arrival. The customer cannot request earlier occupancy; however, earlier occupancy may be possible after consultation with Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH.

On the agreed day of departure, the rooms/holiday flats must be vacated and made available to Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH by nine o’clock at the latest. After 10 a.m., it may demand 50% of the agreed price from the customer for use in excess of the contract. From 6 p.m. onwards, the share increases to 100%. This shall not give rise to any contractual claims on the part of the customer against Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH. The customer is at liberty to prove that Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH has not incurred any or a significantly lower claim to a usage fee.

7. Liability

Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall be liable to the customer for damages for which it is responsible arising from injury to life, limb and health. Furthermore, it shall be liable for other damages based on an intentional or grossly negligent breach of duty or on an intentional or negligent breach of duties typical of the contract. Typical contractual obligations are those which make the proper performance of the contract possible in the first place and on the fulfilment of which the customer may rely. Any further claims for damages are excluded.

If disruptions or defects occur during the term of the contract, Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall endeavour to remedy the same upon becoming aware of them or upon the customer’s immediate complaint. The customer undertakes to contribute what he can reasonably be expected to do in order to remedy the disruption and limit the damage.

Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall be liable to the customer for items brought in in accordance with the statutory provisions.

If Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH provides the customer with a car parking space on a property car park, even for a fee, this shall not constitute a safekeeping agreement. Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH shall only be liable for the loss of or damage to the vehicles parked or manoeuvred there and their contents in the event of intent or gross negligence.

The customer shall be liable to Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH for any damage caused by him or any other person who accepts services from Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH with his knowledge or will.

Animals may only be brought into the booked rooms/holiday flats with the permission of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH. If the customer takes an animal with him/her, he/she shall be obliged to properly keep/supervise it during his/her stay or to have it kept/supervised by suitable third parties at his/her own expense. If necessary, the customer must have insurance that also covers damage caused by animals. The customer shall provide evidence of such insurance to Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH. The customer’s obligation to pay compensation shall also include any damage caused by the animal provided, which Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH is obliged to pay to third parties.

8. Final clauses

Amendments or supplements to the contract, the acceptance of the application or these General Terms and Conditions shall be made in text form. Unilateral amendments or supplements by the customer are invalid.

The place of performance and jurisdiction is the place of business. This shall also apply if the customer fulfils the requirements of Section 38 (2) of the German Code of Civil Procedure (ZPO) and has no general place of jurisdiction in Germany.

Should individual provisions of these terms and conditions be invalid or void, they shall be replaced by provisions that come as close as possible to the content of these terms and conditions. Otherwise, the validity of the remaining provisions shall not be affected.

The right to correct errors, in particular obvious spelling and calculation errors in offers in text form, confirmations or brochures of Andresen Zimmer und Wohnungen Vermietungs und Verwaltungs GmbH, is reserved.
